Terms & Conditions

  1. The “Promoter” of Valvoline SynPower Oil Drain Pan Promotion (“the Promotion”) is Valvoline (Australia) Pty Ltd (ABN 860 004 46855), Suite 603, 2 Burbank Place, Baulkham Hills 2153, New South Wales, Australia.
  2. Information on how to claim and the gift form part of these Terms and Conditions. By participating in this Promotion, Claimants agree to be bound by these Terms and Conditions. Any instructions relating to the Promotion on the Promoter’s website (valvolinepromotions.com.au) form part of these Terms and Conditions.
  3. In the event one or more provisions of these Terms and Conditions are deemed unenforceable, invalid, or void, then the remaining balance of the Terms and Conditions will remain valid and enforceable.
  4. The Promoter may in its discretion refuse to award any gift to any participant who fails to comply with these Terms and Conditions.

ELIGIBILITY

  1. The Promotion is open to individuals who are residents of Australia and are 18 years of age or older at the time of Claim (“Claimants”).
  2. Employees of Valvoline or its affiliates, as well as their immediate family members and household members, are not eligible to participate in the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

PROMOTION PERIOD

  1. The Promotion opens at 12:01AM AEST on Sunday, 1 October 2023 and closes at 11:59 PM AEDT Sunday, 31 March 2024, or until stocks last (i.e. until 3,700 valid claims have been received) (the “Promotion Period”). All claims must be received within the Promotion Period to be eligible.

CLAIM METHOD

  1. To claim the Promotion, Claimants must complete the following steps during the Promotional Period:
    1. Purchase any of the following 6L Valvoline SynPower products with a promotional neck tag in-store at Supercheap Auto and retain their proof of purchase (“Eligible Valvoline Products”);

    2. Visit www.valvolinepromotions.com.au (“Promotional Website”);
    3. Follow the prompts to the claim page, input the requested details (including but not limited to their full name, email address, phone number and postal address) upload a copy of their purchase receipt(s); and
    4. Submit the fully completed form.
  2. Multiple claims per individual are permitted; subject to the following: (a) only one (1) claim permitted per eligible product purchased with a promotional neck tag, meaning multiple Valvoline SynPower 6L products purchased in one (1) transaction can all be eligible to claim a gift for as long as they all have a promotional neck tag; and (b) one (1) claim submission should be made for each eligible transaction.  For clarity, if a claimant purchases one eligible product on one receipt and two products on a second receipt, they would be eligible for three gifts, but would need to submit two separate submissions (one for each transaction).
  3. Claimants must retain their original purchase receipt/s for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of all an claimant’s claims and forfeiture of any right to a gift. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the relevant jurisdiction’s Promotional Period but prior to claim.
  4. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  5. Incomplete (including failure to provide and retain proof of purchase of the Eligible Valvoline Products) or indecipherable claims will be deemed invalid.

SUCCESSFUL CLAIMS AND NOTIFICATION

  1. The claims will be fulfilled at Valvoline (Australia) Pty Ltd (“Valvoline”), Level 6, 2 Burbank Place, Baulkham Hills NSW 2153 at 9am AEDT/AEST (as applicable) on the first working day of each month throughout the Promotion Period.
  2. Successful claimants will not be notified; however, the gift will be sent to their nominated postal address.

OFFER

  1. The first three thousand and seven hundred (3,700) valid claims received during the Promotion Period will each receive the gift of a Valvoline Oil Drain Pan valued at $9.99.
  2. The gift may only be sent to residential or business addresses. The gift cannot be sent to a PO Box address. Claimants are responsible for ensuring that all gift delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a gift, should the delivery details provided by a successful claimant be incorrect.
  3. The Gift is non-transferable and cannot be exchanged for cash or other alternatives.

PUBLICITY

  1. By participating in the Promotion, the successful claimant’s consent to the use of their names, likeness, image and/or voice and other relevant information for promotional purposes by the Promoter, for an unlimited period without additional compensation or further permission, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter except where prohibited by law.

GENERAL

  1. Total gift pool value is $36,963.
  2. If any gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift (or that part of the gift) with a gift to the equal value and/or specification.
  3. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a gift.
  4. The Promoter’s decision is final, and no correspondence will be entered into.
  5. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  6. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
  7. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
  8. The use of any automated claim software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.
  9. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  10. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by the claimant; or (f) use of the gift.
  11. The Promoter may collect personal information (“PI”) from Claimants in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, gift suppliers and, as required, to Australian regulatory authorities. Claim is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.valvolineglobal.com/en-au/privacy-policy/. The Privacy Policy also contains information about how Claimants may opt out, access, update or correct their PI, how Claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles.  By participating the promotion entrants’ consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
