Terms and Conditions – Valvoline Commercial Promotion

1. The “Promoter” of Valvoline Commercial Promotion (“the Promotion”) is Valvoline (Australia) Pty Ltd (ABN 860 004 46855), Suite 603, 2 Burbank Place, Baulkham Hills 2153, New South Wales, Australia.
2. Information on how to enter and prize form part of these Terms and Conditions. By entering this Promotion, Entrants agree to be bound by these Terms and Conditions. Any instructions relating to the Promotion on the Promoter’s website (com.au) form part of these Terms and Conditions.
3. In the event one or more provisions of these Terms and Conditions are deemed unenforceable, invalid or void, then the remaining balance of the Terms and Conditions will remain valid and enforceable.
4. The Promoter may in its discretion refuse to award any prize to any participant who fails to comply with these Terms and Conditions.

ELIGIBILITY

5. The Promotion is open to individuals who are residents of Australia and are 18 years of age or older at the time of entry (“Entrants”).
6. Employees of Valvoline or its affiliates, as well as their immediate family members and household members, are not eligible to participate in the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

PROMOTION PERIOD

7. The Promotion opens at 12:01AM AEST on Tuesday, 1 August 2023 and closes at 11: 59 PM AEST Saturday, 30 September 2023 (the “Promotion Period”). All entries must be received within the Promotion Period to be eligible.

ENTRY METHOD

8. To enter the Promotion, Entrants must:
   1. Purchase a minimum of 100L, in a single transaction, of any of the following Valvoline products during the Promotion Period and retain their proof of purchase (“Eligible Valvoline Products”);

   2. Visit valvolinepromotions.com.au (“Promotional Website”);
   3. Follow the prompts to the entry page, input the requested details (including but not limited to their full name, email address, phone number and postal address) upload a copy of their purchase receipt(s); and
   4. Submit the fully completed form.
9. Multiple entries are permitted subject to the following: (a) the Promoter will award each Entrant one (1) entry for every 100L of Eligible Products purchased in a single transaction. For example, if an Entrant purchases five (5) 20L bottles of All Fleet Plus E900 15W-40 in a single transaction, the Entrant will be awarded one (1) entry. If the Entrant purchases ten (10) 20L bottles of All Fleet Plus E900 15W-40, in a single transaction, they will be entitled to two (2) entries; and (b) each transaction must be submitted separately and in accordance with the entry instructions.
10. Only one (1) Prize (defined below) is permitted per person (excluding SA residents).
11. Entrants must retain their original purchase receipt/s for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the relevant jurisdiction’s Promotional Period but prior to entry.
12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
13. Incomplete (including failure to provide and retain proof of purchase of the Eligible Valvoline Products) or indecipherable entries will be deemed invalid.

DRAW AND NOTIFICATION

14. The draw will take place at Anisimoff Legal, G13, 3 Amy Close, Wyong NSW at 11:00am AEDST on Wednesday, 4 October 2023, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
15. Winners will be notified by email or phone within five (5) days of the drawing and their names will be published online at valvolineglobal.com/en-au/media-room/ from Thursday, 5 October 2023.

16. The first three hundred (300) valid entries received during the Promotion Period will each receive the gift of a Valvoline Cooler Bag valued at $19.99. Only one (1) gift is permitted per customer/delivery address.

PRIZE DRAW

PRIZE

17. The first five (5) valid entries drawn in the prize draw will each win a Prize (details below).
18. The Prize includes a VIP experience for two (2) adults to the Professional Bull Riding Grand Final in Townsville, QLD valued at up to $5,000 (depending on point of departure).
    The prize includes:
    1. Professional Bull Riding Grand Final: Two (2) tickets to the Professional Bull Riding Grand Final hosted in Townsville, Queensland for the following dates: Friday, 3 November 2023 and Saturday, 4 November 2023; and
    2. Flights and Accommodation: The Professional Bull Riding Grand Final will take place in Townsville, Queensland. If the winner and their nominated guest are not from Queensland, the prize will also include: (i) two (2) return economy class airfare tickets from the winner’s nearest capital city to Townsville, Queensland on the following dates: Friday, 3 November 2023 and Saturday, 4 November 2023 and (ii) accommodation at the Ville Resort-Casino, Sir Leslie Thiess Dr, Townsville QLD 4810 for two (2) guests on the following dates: Friday, 3 November 2023 and Saturday, 4 November 2023.
19. The Prize is non-transferable and cannot be exchanged for cash or other alternatives. The winners and their nominated guest acknowledge and agree that they must travel on the dates stipulated by the Promoter. All travel arrangements, including flights and accommodations, will be made by the Promoter or its designated travel agency, and the winner and their nominated guest must travel on the same itinerary. The winner and their nominated guest are solely responsible for obtaining any necessary travel documents, such as passports or visas, and for any expenses not explicitly stated in the Prize description, including but not limited to meals, transport to and from departure points, personal expenses, insurance, in room charges and all other ancillary costs are not included in the Prize.
20. The winners and their nominated guest must depart from and return to the same departure point. Frequent flyer points will not form part of the Prize. If the winner and their nominated guest reside in Queensland, then the Prize does not include airfares and the airfare component of the Prize is not redeemable for cash.

PUBLICITY

21. By participating in the Promotion, the winner and their guest consent to the use of their names, images, and other relevant information for promotional purposes by the Promoter, without additional compensation or further permission, except where prohibited by law.

GENERAL

22. Total Prize pool value awarded by chance is $25,000.
23. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
24. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
26. The Professional Bull Riding Grand Final ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
27. A draw for any unclaimed Prizes may take place on Monday, 17 October 2023 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in phone by email, within five (5) business days of the draw. Winner’s names will be published on the Valvoline Australia website valvoline.com/en-au/media-room/ from Thursday, 20 October 2023.
28. The Promoter’s decision is final and no correspondence will be entered into.
29. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
30. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from the relevant regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if the Professional Bull Riding Grand Final event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by the Entrant or winner; or (g) use of the Prize or attendance at the Prize event.
35. As a condition of accepting the Prize, the winner shall sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
36. The Promoter may collect personal information (“PI“) from Entrants in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at valvolinepromotions.com.au/privacy. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their PI, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
